    PART III: INTERPROVINCIAL AND EXPORT MARKETING OF WHEAT BY THE CORPORATION
    Regulations and Authorizations respecting Certificates and Accounts
    Transfer of undistributed balances
    39. (1) Where producers of any grain sold and delivered during a pool period have been for six years or more entitled to receive from the Corporation payments in respect thereof under certificates issued pursuant to this Act or out of an equalization fund, or otherwise, and there is an undistributed balance remaining in the accounts of the Corporation in respect of that grain, the Governor in Council may authorize the Corporation

    (a) to adjust its accounts

    (i) by applying the undistributed balance in payment of the expenses of distribution of the balance mentioned in subsection 33(2) with respect to the same kind of grain in any earlier pool period, and

    (ii) by transferring the remainder of the undistributed balance to a separate account; and

    (b) to pay to the persons who are entitled to receive payments in respect of that grain the amount to which they are entitled out of the separate account.

    How transferred balances to be used
    (2) Any balance transferred to the separate account pursuant to subparagraph (1)(a)(ii), other than such part thereof as is required for the payments referred to in paragraph (1)(b), shall be used for such purposes as the Governor in Council, on the recommendation of the Corporation, may deem to be for the benefit of producers.

      I understand that the CWB has the legal authority to take money from the pooling accounts, and they have certainly taken their authority seriously.

      GRAIN STORAGE RESEARCH FACILITY.

      Her Excellency the Governor General in Council,...on the
      recommendation of the President of the Treasury Board and The Canadian Wheat Board, ... hereby
      authorizes a contribution.., a sum not exceeding $400,000 to fund the purchase and installation of equipment for the University of Manitoba Grain Storage Research Facility, on the condition that sufficient
      funds from that account are available.

              explicit purpose of plant breeding research, and (b) designates the WESTERN GRAIN RESEARCH FOUNDATION as the "research funding agency".

                With so much inflation, the CWB saw fit to increase your % of deductions to Western Grains and they made it legal by gazetting:



                2005-08-31

                Order which, among other things, (a) increases, as of August 1, 2005, the amount that THE CANADIAN WHEAT BOARD shall deduct from final payments for
                the purpose of plant breeding research, and (b) designates the WESTERN GRAINS RESEARCH FOUNDATION as the research funding agency

                  Her Excellency....on recommendation of the ...The Canadian Wheat Board, ....hereby authorizes The Canadian Wheat Board to pay to the Canadian International Grains Institute, from the separate account referred to in subsection 39(2) of that Act, the sum of $300,000 to defray the capital costs of the Canadian International Grains Institute, on the condition that sufficient funds from that account are available."


                  And this happens year after year.
