    spray drift

    Out checking a Invigor canola crop and
    neighbors had spray drift damage on to
    my crop. They sprayed 10 days ago, using
    infinity, along the fenceline 10-15
    acres are really cooked and noticable
    damage 20-25 acres in. Headed back out
    this morning for pictures and to check
    growing points. Thinking of getting an
    agrologist in to document the situation.
    Third time in five years to see, some
    damage from the boys in black,
    acknoledge there is damage across the
    fence. Looking for some thoughts on how
    to handle this situation.

    get crop insurance to look at the damage and document it.take lots of pictures the most documentation always wins.SEnd the black bastirds a bill.

            if you are serious about collecting from anybody no matter the color of clothing, I also would suggest having Sask Crop insurnace do a plant count and measure damage there are some very skilled people working there and they are most accurate.. Take several pictures, they dont lie, and they dont forget.

              Some neighbors just don't give a crap...they spray only when the wind is in the wrong direction..

                I think its happening less now with better nozzle technology and using the head. Everyone has insurance for spray drift in the farm policy, you must talk to them and get together to look at and assess the the damage now not later. You can both then decide what to do, if they do not wish to go through insurance they can offer a payment, if it is satisfactory you can settle or ask for more, if they do not settle you must give them a demand letter if they do not go put in an insurance claim. If they agree to insurance claim you then only deal with the insurance company and the boys in black are off the hook. Its not easy, the drift can go the other way some day and they may want the insurance claim filed while in the past you did nothing and no evidence. I believe if you have trouble getting them to file the insurance claim and you really cannot settle you may want to ask them which company they deal with for insurance and you can also file the claim without them, more neighborly for them to do it but if you think it should go to insurance you can file the claim for them. The adjuster will come out and do your other dirty work of dealing with them for you.
