    The Trespass to Property Act

I've come to the realization that the only way to keep the public out of abandoned farmyards is to level those sites as people, even with good intentions, will not ask for permission to enter. It's a shame that it has to be done to historic structures, but these attractive nuisances are drawing magnets for grief. The regular latest yesterday was catching an old cogger from White Rock, BC, with a camera, driving through my standing durum to reach a stone house, and a stone barn foundation. Normally, it's from people stealing the cut stones for pathways to their cabins. Is this act any real wake up call to the public?

    well I know what it would cost an oil company if they did that, What will it cost this old cogger from White Rock???? Are you sure he's not some elitist artist that sells his art an' photo's in some very upscale art house in West Van ! ??? don't be fooled.

      What were the laws there before? In Ontario, basically any land being actively farmed, including woodlots and pastures, is automatically supposed to be considered as posted for no trespassing and the onus is always supposed to be on the trespasser to prove otherwise. It's almost impossible to find a police officer who's aware of this and will enforce it though. In fact I know of several instances in this area where the "trespassers" were off-duty police officers hunting on private land

        Dalek, what was the law here before? Charges under the federal Criminal Code. New way - tickets up to $2000.00 for the police to deal quickly and easily with simple cases of trespass. Most farmers would likely choose posting signs as a means of warning outside venturers. Onus is on the trespasser to prove he had the right to be on our property which would mean fighting the ticket from my read of the Act.

          Boarderbloke, I know where you are coming from, and my 15 minutes of verbally chewing on him likely wasn't enough, but I could tell he was remorseful and apologetic. He was directed to the property by local family that he was visiting, and was driving their vehicle. Would you kick a 75 year old man's ass that was driving an automobile with the licence plate "HEALTH"? Now, had the access point been posted, like I just did today, and this present law been in effect, the professional bridal website business designer who visited the site unannounced last fall with his model in full bridal gear out of Regina, would have been a different story. As it was, there was no apology coming from him with his god given right attitude. I, therefore, informed him he was not going to drive his low clearance car out the same way he came in. He was to stay out of my unharvested crop to reach a harvested pea field and an approach. As he drove through the tall grass of the yard and its scattered minefield cut stones it was clunk, clunk, clunk!! I'd be surprised if his oilpan made it very far down the highway!

            When I spent a week on Hornby Island, BC, I found the sign posted on the island was most effective:

            "No Trespassing: Survivors Will Be Prosecuted."

            Erect one.
