    Canola Seed

    Is the reason that they keep introducing new varieties
    because the patent eventually runs out on that
    particular variety and then we would be able to use it
    free of charge?

    Anybody know about this?

    The simple answer is NO.

    Patents are different. Usually now Plant Breeders Rights apply to virtually every grain seed that is registered in Canada. As a seed grower we do not have old varieties that the royalties do not apply to and stop being charged.

      Simply a way to keep increasing prices for the "NEW AND IMPROVED" varities. I'm not saying there hasn't been some advances in the benefits of some new varities but the seed cost has gotten out of hand as far as I am concerned.

        I'll say it again their was a spike in yields a few
        years back but since recycled shit. L150 I have
        had for three years few bags first year. It's been a
        disappointment since it came out. Bayer will loose
        4000 acres.

          In 1998, I was the first guy to grow
          invigour in our area. The variety I grew
          was 2153. It was 2.99 a lb. It came out
          of the ground and GREW. Even the
          cotyleydon pre first leaf got HUGE, no
          joke. The last of the 20 series I grew
          were 2573, 2663. They stand to this day
          as my highest yielding canola on this
          farm. They came up, they grew huge, and
          stood well, better than the 2153. And
          then something went awry. I grew 5020
          and 5030 for two years, and never saw
          that vigour ever again. So I quit
          growing the stuff.

          Finally, for rotation reasons of the
          herbicide realm, I broke down and bought
          some L130 this year. I will say to me at
          least, other than a slow start because I
          seeded too deep, (yes I will take the
          blame, too wet to seed last year, and
          tilled fallow and my seeder are
          enemies!LOL) it looks FANTASTIC! It is
          so late from being seeded June 7th, and
          from poor emergence due to the above
          mistake. But it did grow, and hopefully
          it remains standing and does not freeze
          until Sept 15th.

          Perhaps Baye got their act together
          again, perhaps not. All I know, is that
          their original varieties I was getting
          phone calls and roadside stops, and oohs
          and awes for a few years there, while I
          was keeping it a secret. Then it went to
          pot. That is my thought on the evolution
          of invigour hybrids. I remember old AC
          Excel and getting 40 out of it spraying
          poast and treflan and muster, and the
          seed was 45 cents untreated, or 95
          treated. GRRRR!!! Now we hope for
          similar yields, and pay 10 bucks for the
          seed, but at least no tillage and
          treflan and such. lol

            Thanks Tom,i don't have time to read link,to busy
            swathing a shit canola crop,but i also wonder if
            someday normal patent laws wouldn't be applied
            someday in a court battle???..dont know much about
            the subject but the race to constantly different
            varieties makes me wonder.

              I will note that acreage for crops that farmers buy seed for every year (read canola) whereas crops that have the opportunity to use farm saved seed have either been stable or declining. Nobody has mentioned hybrid seed but also a part of this equation.

              Someone will have to explain to me why most farmers push canola acres in their crop rotations to the breaking point of bad agronomics/too tight rotations and yet it is the only crop they complain about high seed costs/too many acres. Everyone will tell me they will back down on acres next year but I would bet 20 plus million will go in again in 2013.

                  capitalize on that mother ****er grow it and kick ass

                          5440 was way better thn these 150s. It's bs when
                          it's off patten it should be open they made their
                          millions.

                            Had 5440 and L150 side by side last year. 5440 looked and yielded better by a couple. So decided to grow only 5440 this year. It grew nice, straight up and swathed like a breeze. L150 fields appear thicker and lodged and leaned more but not sure if they will yield any better. Been custom swathing some and its a real pain in the ass to cut. The 150 did seem to handle the heat well but seems to have a little smaller pod than the 5440.

                              Varieties are not patented. It doesn't
                              matter what variety of RR or liberty
                              canola you grow, the intellectual property
                              rights is on the one or more genes within
                              the variety.
