    Questions for the WCWG

    This from a paper in Manitoba.

    ""The Western Canadian Wheat Growers Association is looking to recoup the money spent by the Canadian Wheat Board in its fight against Bill C-18.

    "We have every intention to get farmers' money back, and if that money has to come from the Wheat Board's insurance company from the directors' liability insurance, that's good. If the insurance company says 'you guys knowingly broke the law, you can't do this,' well then we'll have to go after Oberg and the other directors to get the money back into the pool accounts," says Wheat Growers Chair Gerrid Gust.

    He believes the case could end up affecting the eight former directors personally.

    "I hope so. It's affected all of our farms personally. They've all taken director training. They all know the law, and they know the consequences of breaking the law," he says.

    The lawsuit cites the 2006 Order-in-Council that prevents the CWB from advocating its single desk.

    Gust says they're waiting for a final court decision on the government's appeal before moving forward with the lawsuit. The government is appealing a Federal Court ruling that said the Agriculture Minister breached the former CWB Act by introducing Bill C-18 without conducting a producer plebiscite.

    "Our lawsuit is on hold until the Court of Appeal rules that Judge Campbell maybe overstepped his bounds. He's been overruled before," says Gust. "His is a very important opinion, but he does not have the final say on this." ""

    1. Why wait, the cwb was not to use pool money to promote the cwb monopoly?

    2. The cwb used the article in the old act to say there had to be a vote. Why not use the order that the government issued to quit using farmers money?


    3. Why wait, it took the Italians close to 30 years to get that 5 million out of the cwb. The cwb has a pretty good record on hiding and delaying things to the point where everyone forgets? On a side note how is the Huyde case going???

      As a former director of a corporation,
      your lawyers tell you EXACTLY what you
      can or can't do with shareholders money
      . Acting against a court order is not
      one of them.Directors are totally liable
      for miss appropriation of funds.Go for
      it Gerrid, will be a slam dunk, glad I
      am not in their shoes....

          Thanks for the question bucket. The short
          answer is because that's what our lawyers
          have advised.
          One shouldn't pay high priced Bay st lawyers
          to ignore their advice.

          Why Bay st lawyers you ask?
          Try finding a lawyer capable of this case in
          Western Canada who hasn't done some work for
          the Monopoly in the past generation.

          As always members can call any time.
          A good reason to come to our AGM is to get a
          better report.

            True once a law firm has worked for someone or organization in the past they are then barred from working for that persons opponent in the future. Do they really have all the law firms tied up?

              Hopper they are not really "barred" they just have to declare conflicts of interest.

              Although the net effect is similar. If A law firm has done work for the Monopoly the monopoly's lawyers can slow thing down significantly. Any slowdowns or roadblocks can be argued but all of that takes time and money.

              At the WCWGA we are using members dollars donated specifically for this project. As directors we are trying to be as careful and prudent with members money, as we would with our own.

              Time lines have taken longer than we would have liked. but we are still on track

                  @katoe. Not sure if you know this but on the
                  right we donate money to parties who have
                  policies we agree with. More of a grass roots
                  system.
                  Unlike on the lefts top down system where
                  they tell you what to think or pander to you
                  doing what they think you want, without ever
                  really asking.

                  If you are referring to that money we
                  received from the feds to investigate the
                  Barley clearing house project. We paid ALL $$
                  to the project. We kept $0 (zero) for admin.
                  You see we have members and sponsors who
                  support the work we do. That's where the $$
                  come from.

                  Let's hope the Feds open the books in the new
                  year and we can see where the Monopoly spent
                  our money!
