Yup, and he also claimed that Justice Campbell was wrong in saying that the Feds had to give notice of a constitutional question before arguing that s. 47.1 violated the constitution. He claimed that because they were there, the Feds had notice.

Ooops. It seem he forgot that under the Canadian Constitution each of the ten provinces is required to be given notice of a constitutional question, as well as the Feds. Seems no notice was given to them.

He also forgot or missed a few other fine points that matter in the law, but on the big question of whether the court will intervene we agree that isn't very likely.
