The we refers to the fact that Indian act still exists, along with the reserves, the systemic racism, discrimination and the legacy of colonization and all the other terrible things that happened to first nations including residential schools.

So untill we fix the many of the of the problems we created and the legacy of harm, the word we is totally appropriate.
