    Canada’s beef and pork sectors welcomed today’s long awaited decision by a World Trade Organization (WTO) Dispute Settlement Body (DSB) Arbitration panel with great satisfaction. The arbitrators have determined that Canadian livestock producers have suffered annual damages in the amount of $1.055 billion CAD.

    U.S. mandatory Country of Origin Labeling (COOL) has been in effect since 2008. As the arbitrator’s finding shows, in these seven years the cumulative losses for the Canadian beef and pork sectors have been staggering. At every step of the process, the WTO has repeatedly found that the U.S. is in breach of its WTO obligations. The only revision the U.S. has made, in 2013, increased the negative impact on Canadian farmers and meat processors.

    Our patience is exhausted. There is no further negotiation to be done and no compromise is acceptable. Canadian livestock producers and meat processors expect the U.S. to do nothing less than repeal COOL or face the immediate imposition of retaliatory tariffs on U.S. goods to the same extent as the damage we have endured.

    We applaud the Governments of Canada and Mexico for their persistence in moving the lengthy WTO process to this final point. We will continue to support them as they move forward with the imposition of tariffs on a combined $1.01 billion USD of imports from the United States.

      It's not the full three billion, but still a decent chunk of change. Hopefully enough to get them to notice.

      Apparently there is an omnibus bill going up for a vote on the 11th, which they could put a repeal into. Now it's up to our dysfunctional neighbour politicians to see if they can get it done. Don't hold your breath. They aren't very good at this sort of thing.

            An example of how COOL has been working. This notice is on the website for the livestock auction in Dickinson ND. I suppose this has been the policy for some time. Of course it affects Canada..

            "If you want to sell any CANADIAN BORN CATTLE, you must inform the office and sign an affadavit. avit.
            FAILURE TO FOLLOW THIS PROCEDURE COULD RESULT IN RECEIVING NO VALUE FOR YOUR ANIMAL(S)."

                Looks like COOL is in the omnibus bill. At least according to the news today.

                Will it change things? I would think it should help the cows first. There's something about the futures and Canadian cattle too, but maybe someone who's more knowledgeable can chime in on that.

                  OMNIBUS WOULD REPEAL OIL EXPORT BAN, COOL: Republicans late Tuesday night posted a massive spending plan to fund the government through September 2016, with plenty of crucially constructed deals to try to appeal to both liberals and conservatives ahead of votes in the coming days to avoid a government shutdown. The 2,000-plus-page package pairs the lifting of the 40-year-old ban on U.S. crude oil exports with prized extensions to wind and solar tax credits. It would repeal mandatory country-of-origin labeling requirements for meat in a bid to stave off hefty retaliatory tariffs.

                  The COOL labeling rider could be coming just in the nick of time, with the World Trade Organization scheduled on Friday to approve Canada and Mexico’s plan to slap U.S. exporters with $1 billion in retaliatory tariffs over the program.

                  Senate Agriculture Committee Chairman Pat Roberts said Tuesday that the issue of meat labeling will probably continue to be an issue, but “we’re just trying to stop the retaliation, and of course the way to do that is to repeal it.” Debbie Stabenow, ranking member on the committee, struck a similar chord: The proposed omnibus provision “will definitely at a minimum meet the WTO requirements,” she said several hours before congress announced a final deal.

                      Canada should have lowered the boom on the Americans when COOL was first initiated. Canadians are so NICE and the years went by and the USA benefited all the way.

                      We should have threatened to do way with the NAFTA in fact but NO we were too freakin' NICE.

                      Maybe the USA will have learned something but don't hold your breath...they'll come back with some crooked scheme sooner or later.

                          Regarding Cool.So, what did we learn from this? While our cost was years of multi billion $ losses to beef/pork producers, the Canadian processor/retailer/consumer benefitted from our depressed prices as our politicians did as little as possible and ensured Canada's cheap food policy stayed in place. After all countervail action is actually a tax on the consumer to offset trade action and support the affected industry. So, 7 years of trade restriction and the US cost is $0.00, the Canadian consumer benefitted and we are happy our politicians really stepped up for us. Ha! Next time, after the first WTO ruling against the US our wonderful politicians should step up and slap on serious countervail, protectionist and punitive duties and let the Americans waste 7 years and millions of $ on appeal-repeal actions. At the 11th hour we say oops, sorry. This has been NO deterrent to future actions in any sector. The Americans know we play nice and within the rules. Rules which they are more than willing to bend again and again. Meanwhile as an industry we have to drive home the point to our elected representatives that we hold them responsible for their inaction and we demand better, much better!

                            True enough comtex but there is the lengthy appeals process to go through. Shows me the Americans play this kind of game smartly to benefit themselves. Reality is we are the mouse compared to the US elephant, we need to export beef to them, they don't really need us so we can't go throwing any weight around as the odds are not in our favour.

                              The sheep people are more than upset that this repeal doesn't apply to lambs. I don't blame them. They got pounded by be even though it doesn't affect sheep. Now they are still stuck with cool.
